Citimortgage Misapplied My Payments

My whole ordeal began back in Sept '07 - when I decided to pay my mortgage note online for the first time.

I had been traveling, and did get a chance to mail my payment by check, as I normally do - and when I called to pay by phone I was told that, it would a $25 charge to get a human to process my payment, for for $15 bucks less, I can get the computer (online) to process my payments.

Well even though I was weary of paying online (you have to go with your gut ALWAYS) - the representative assured it was:

Fast, Safe and above all CONVENIENT!

It may have been fast, it may have been safe, but it was far from "convenient," - my concern grew when I had not seen the payment debited from my account a few days later, and that's when I discovered that my payment was being processed at TWO months and not ONE.

I did not have sufficient funds to cover two months, along with my other monthly expenses, and because there was not enough funds to cover these two months, I had incurred NSF insufficient funds fees as well.

After a phone call to the bank, and then to Citimortgage to explain and clear up the mix up. The representative on the phone at Citimortgage that day 9/17/07 - said:

"I see the problem, and I'll take care of it."

I can hear his voice as plain as day in my head, replaying that phone conversation, that assured me all will be well and right in my paying-down-my-debt world. Boy was I.....

WRONG!

Turns out, that representative, reversed the payment, instead of processing my payment. And in that reversal- the system reversed the last payment processed which was August.

Now we're heading into October, and I resume payment by check and mail that in - and I am still waiting for Sept to process and clear. That's when I notice an additional deposit in my account for the same amount as my monthly note.

Turns out that representative who said:

"I see the problem, and I'll take care of it...."- didn't

He didn't see the problem, and nor did he take care of it. In fact he caused me major problems since then. The reversal he did, searched for last payment process, which was August (as Sept was still tied up). And when I sent in my October payment by check, Citimortgage refused it.

Could you believe it? They refused it, stating that it was not the full amount due, and that's why they were returning the check. Because now, I owe for August, September and (now) October -= 3 months.

Which meant I was heading into foreclosure, all because of payment online processed wrong.

But wait it gets worst, or should I say better, because you have to really laugh inspite of.

Now were going back and forth, Citimortgage and I, and were heading into November, I pay them the full amount due:

August - which was reversed in error

Sept - which never processed online

Oct - which is the check they sent back

I pay this all at once debited from my account via phone call (this time minus the $25 human charge fee) and could you believe it:

THEY MIS-APPLIED THESE FUNDS!

To date, I am still in account review with Citimortgage about this one time payment of 3 months, that add up, I *still* owe a month, even though I have the bank debits to prove that each month has been debited.

Every time, I call I get a different story, but I am glad that for my own sanity, that my story has not changed, and Citimortgage is at fault.

All I want is this matter corrected, and ALL negative judgment on my credit report, corrected and restored.

I am having the same problem and it has happened periodically over the last two years. I now send every payment to them via Express Mail, so i have proof they signed for it. that is costing me an addiitional 16.75 per payment to mail and I send it to their Corporate Office address in Maryland. unfortunately i am fighting them now on a missing payment that my husband mailed in for me to the Des Moines PO Box. They claim they never received it. I have hired an attorney in the past to resolve this but now it is happening again. count me in on a lawsuit if anyone proceeds with this

I sent my June 2008 payment in on time and I checked my computer account, but the payment never showed up. The bank confirmed that Citimortgage did cash the check on the 11th, yet they charged me a late fee saying the payment was not received by the 16th. It is the 23rd of June and they still have not applied the payment to my account. I am sick of the run around. No one will help me even though the cancelled check proves they have the money.

We too are fighting Citimortgage. We've had everything from misapplied payments (pre-paid months in advance with full copies of both checks and statements noting the payment be applied to future months payments, NOT additional principal, to a mistake, admittedly occurred by our personal bank, that caused a payment to be returned to Citimortgage unpaid, but caught, and our personal bank sending letters and faxes and phone calls not only through the local branch, but through their "resolution" department, asking for Citimortgage to understand that it was the banks fault, not ours, but to no avail. Citimortgage has repeatedly responded to us and our bank (a National "Wells" known banking insitution, that they will not remove the negative notation from my husbands credit report because it "was not THEIR fault". I am currently speaking to a few lawyers about a class action law suit (after 10 months of trying to have Citimortgage come to an agreement and remove the negative comments from the credit report) so anyone else who has had this problem, contact me and we'll see if we can't get some kind of action out of Citimortgage.

Stories like this is floating around more and more, and at the core is the name Citimortgage - it's time people fight back. Don't give up, settle this dispute! Fight back.
